Estate and Trust Administration

When a loved one passes away, T.J. advises personal representatives named in their will and engages with them in the probate court process, as well as trustees and interested beneficiaries.

These services include, where necessary, petitioning a court for appointment as a fiduciary, identifying the assets of an estate or trust, paying creditors, working with your tax professional for filing income and estate taxes and distributing assets, as well as other related matters.

Regardless of which type of administration is necessary, there are certain tasks that will be required of the fiduciaries such as personal representatives and trustees.

The following are common tasks T.J. assists fiduciaries with, as necessary:

Identifying and placing assets in the name of the Estate or Trust

Appraising all assets at their fair market values

Filing an affidavit regarding the decedent

Sending required notices to the decedent’s legal heirs

Sending required notice of the decedent’s death to the beneficiaries of the Will or Trust

Managing assets according to the Will or Trust agreement

Assisting Clients with opening a bank account for the Estate and/or Trust

Determining the beneficiary interest in the decedent’s retirement accounts

Notifying all financial institutions and banks of the decedent’s death

Filing the necessary accounting and associated paperwork at probate to close an estate in order to distribute assets to beneficiaries
